Dartmouth teen accused in killing gets trial postponed

A trial for a Dartmouth teen accused of killing Chelsie Probert last June won’t be going ahead in Halifax youth court next month as scheduled.

The trial for the 17-year-old boy, who is charged with seconddegree murder, has been postponed until September at the request of the defence.

Judge Elizabeth Buckle granted the adjournment this week and rescheduled the hearing for Sept. 4-21.

The boy, whose identity is protected by the YouthCriminal Justice Act, got bail last October.

He remains on house arrest under the supervision of his mother.

Probert, 18, was found injured on a walkway between Albro Lake Road and Farrell Street in northend Dartmouth on the night of June 6, 2017. The Halifax woman died in hospital.

Probert was arrested June 22. Police have said the killing was a random act.

The Crown has served notice that if the youth is convicted of murder, it will attempt to have him sentenced as an adult.

Defence lawyers Brandon Rolle and Josh Bearden asked that the trial be adjourned because some of the evidence against their client has yet to be disclosed by police.

Crown attorney Jamie Van Wart, who is prosecuting the case with Steve Degen, said the defence request was reasonable.

“Because we’re dealing with a youth, we’re trying to do things as quickly as possible,” Van Wart told The Chronicle Herald.

“But September is still pretty quick. (The homicide) just happened last June.”
