Halifax nurses on strike after province tables essential services legislation

According to a post on the union’s Facebook page earlier Thursday morning, the nurses are now gathering to discuss the essential services legislation tabled Monday night.

Premier Stephen McNeil said the legislation was necessary after the union filed notice that they were preparing to go on strike Thursday.

The 2,400 nurses with the NSGEU are in a legal strike position on Thursday.

According to media reports, Jessome is not sure how many nurses will walk off the job.

The Facebook post says nurses plan on marching to the legislature to protest and speak before the Law Amendments Committee.

The Essential Health and Community Services Act would require unions and employers throughout the health-care sector to have an essential services agreement in place before job action can occur, and if such an agreement can’t be reached, an independent third party decides.

Employers or unions that take job action before an essential services agreement is in place would be fined $100,000 for the first day and $10,000 for each additional day. People would face fines of $1,000 for the first day of job action and $200 for each day after.

McNeil said the fact that there have been three health-care labour disruptions within seven months underscores the need for such a law.

“This is about striking a balance between ensuring that Nova Scotians have the services when they need them while protecting the workers right to strike,” McNeil said outside the legislature.

Labour Minister Kelly Regan said Nova Scotia was the only province without that kind of legislation.

“Like all Canadians, Nova Scotians deserve to know their health and safety won’t be in jeopardy during a labour disruption,” Regan said in a statement.

In addition to nurses, the bill would apply to paramedics, 911 operators, hospital employees and people who work in homes for seniors, youth and people with disabilities. In all, about 35,000 to 40,000 workers would be covered by the law. It would take effect as soon as it is passed and not expire.

The move came after the Nova Scotia Government and General Employees Union filed strike notice to Regan earlier in the day. The 2,400 nurses that the union represents are in a legal strike position as of Thursday.

Union president Joan Jessome met with more than a dozen nurses gathered in the legislature foyer Monday night where she slammed the bill, saying the Liberal government has angered health-care workers.

“This legislation is draconian — it’s one-sided in favour of government and the employers and it has set labour relations back a century,” she said.

“(The premier) has just told them, ‘Don’t speak up for patient safety, don’t speak up for the work you do or the services that Nova Scotians need, because when you do that we’ll use the hand of the law and take all your rights away.’”

She said she has heard from some nurses who have indicated they will not go to work Tuesday.

The union and the Capital District Health Authority have been unable to come to an agreement despite the help of a mediator.

Late Monday night, Capital Health said on its website that mediated talks ended in an impasse. A spokesman for the health board said earlier Monday that as the strike deadline approaches, it continues to cancel surgeries and transfer patients to hospitals outside of Halifax.

The key sticking point in the dispute is a demand from the union to increase nurse-to-patient ratios, something it says would improve patient safety. The health authority has said there is no evidence that mandated ratios guarantee better safety.

The essential services legislation would also allow parties to request conciliation or mediation to help negotiate an essential services agreement, and if they can’t agree, either party could apply to the Nova Scotia Labour Board.

“Most employers and unions reach collective agreements without strikes or lockouts, but even the possibility of a labour disruption can create stress and confusion,” Regan said.

“This bill gives certainty to people who need and provide care, and ensures essential services must be provided in the event of a strike or lockout.”

Progressive Conservative Leader Jamie Baillie said outside the legislature after the bill was introduced that he was disappointed the premier didn’t allow negotiations to run their course.

NDP Leader Maureen MacDonald said she was shocked that the legislation would apply to so many health-care employees, calling it “heavy-handed” and adding that her party will not back it.

The Liberals hold a large majority in the house.

The bill marks the second time in a month that the party has introduced essential services legislation.

On March 1, the government passed a law to end a one-day strike by about 420 home-care workers in the Halifax area.

    I totally agree!!!! There doesn't seem to be a care for the patients who really need health care services ppl who are in need of surgeries , all they are doing is causing unneeded chaos for these poor ppl!!!!!!!

    Kudos to the Premier for putting in this legislation. I for one am tired of hearing how all of these actions are being done because of safety for the patient. This is being done nothing more nothing less to give nurses more benefits. The national average show NS is higher per patient ratio by 200 hundred nurses. Has patient care improved , no. The ones who are paying for this action, are the people having surgeries cancelled, early patient discharges and patients being moved to other areas because of the nurses. The argument that more nurses are needed because NS has more seniors, doesn't fly either, the population in all of Canada is aging! Let the nurse go out, fine them and the Unions, and if the nurses chose to leave the province so be it. In the end, Nurses will come to NS to work! In this province we repeatedly go through these threats every time , the Nurses come to the table, enough is enough. Yes, they are taxpayers , but so are the rest of the people in the province, and I for one am tired of this. Every agency that serves the public is short staffed and overworked! I don't see Joan Jessome beating the drum to help these other agencies! She only seems to come out from behind her office doors when the Nurses are involved, and then she screams, patient safety, what about all the other agencies you serve, what about their clients safety and the Staff's safety. Sorry, time to rein in this foolishness!!
