'Discrimination' alleged in local chamber's best business competition

TRURO - An area businesswoman who has been excluded from a Chamber of Commerce competition is crying foul.

"I feel I'm being discriminated against," said Dana Hernden, who owns the local real estate listing service, PropertyGuys.com.

"I would say that they are trying to keep me out of the competition because they don't want me to gain any votes or they don't want people to see the results of the votes."

Hernden said her business was nominated in the real estate category in the chamber's annual Best of Colchester competition but when her clients visited the site to vote, there was no listing for PropertyGuys.com.

She then received a phone message from the chamber "stating that they had revoked my nomination and that I didn't suit the category of real estate," Hernden said.

"I'm not exactly an agency but that is the category I was nominated for," she said. "I asked why my category was pulled and they said that they didn't define me as an agency. But I imagine I would still fit under the heading of real estate ...."

Hernden agrees she is not a real estate agency but feels her business could've remained in the competition by simply adding "real estate/services" in the group heading.

"I wouldn't be having this argument if there weren't other businesses under a broader umbrella of the category that didn't exactly fit or suit the exact name of the category," she said.

The Best of Colchester contest is an online competition hosted by the Truro and District Chamber of Commerce in which members of the public vote for their favourite services and business in 25 separate categories.

Given that some of the categories, such as Financial Institutions, Veterinarian/Groomer/Supply/Boarding, Contractor Building/Renovations/Repair and Computer Sales/Repair/Support do encompass broad definitions, Hernden questions the reasoning she was offered for her exclusion. And that is especially so, she said, in light of the fact that the new chamber president Todlyn MacPherson, is also an associate broker with Royal LePage in Truro.

PropertyGuys.com franchises are direct competitors with traditional real estate agencies.

"I clearly am different from them. But I'm still in the real estate business, it's a different kind of business ...," she said.

"My customers have a right to vote for their favourite person in real estate. And the problem I have with it ... I have clients who want to go on there and vote and they're not seeing my name."

Hernden said she joined the chamber specifically as a way to help market her business but now feels it is working against her.

"The chamber's mandate is to help all businesses and give everybody a shake in business and one of the reasons I joined the chamber as a new business is to promote and profile my business. And they're not letting me on (the competition site)."

Tim Tucker, the chamber's executive director, said the decision to not include Hernden's business was solely his and it was done at the last minute after he determined the company did not fit under the category of real estate agency.

"What I told Dana is that if she was a real estate agency, then I totally agree with her. But she's not," Tucker said.

"The categories were made to try to get them as broad as possible, unfortunately, there's a bit of a sticking when it comes to real estate agencies, it has to be fully licensed as a real estate agency," he said.

"Where the category is called Real Estate Agency, then it makes it very difficult to include somebody in there who isn't a licensed real estate agency."

And with more than 450 members under the chamber umbrella, Tucker said there is just no way to accommodate all the individual categories that would be required to be all inclusive.

As far as trying to make adjustments to be able to include PropertyGuys.com, Tucker said, "we're definitely looking at that for next year but we just didn't have it done this year in time for the voting."

And given that the voting had started before the issue came to his attention, Tucker said it was too late to change the heading for this year.

As for any conflict on the part of the chamber president, however, Tucker was adamant that was not the case.

"Absolutely and 100 per cent not," he said. "I'm completely sorry if Dana gets that impression but it has nothing to do with it."

    The Chamber should cancel the whole category for this year and re-evaluate their position at the board level. The executive director should not have the final say in excluding a business from competition. After all, does not the Chamber encourage competition?

Seems pretty straight forward to me........they did inadvertently help accomplish the final statement about exposure - they exposed her market leading business and exposed themselves for their mistake.

    I find it funny that most of the comments on here are ones bashing the Chamber/Mr.Tucker when I know for a fact that more positive ones about the whole issue have been sent in to the paper. Weird how none of those got posted. Makes you wonder doesnt it?

    I agree that the Chamber should have acted long before they did. In the best interest of all their members (and their happy clients) they should have made the adjustment. Our local paper does a similar thing and they have "Best Real Estate Person" and "Best Real Estate Office". Problem solved!

    Dana, Well, you are a winner in your customers eyes! The revocation does sound fishy given all the other "broad" categories. It would concern me that the chamber was influenced by others in this decision and there might be a conflict of interest. If you are a member, then shouldn't they they provide you with a new category? Having said that, your clients know the services you provide and how you provide them.

    I have to disagree with most of you, and the fact that the Truro Daily would print this shows how out of touch they are with the business community. Truro deserves much better then this yes, and it would be great if the Daily actually went out to get all the facts instead of spinning the story in such a way. How can anyone not understand that PropertyGuys.com does not fit Real Estate Agency? They market themselves as not being this so why would they want to be treated any differently? In Closing Shame again on the Truro Daily for this spin of the story it won't be a surprise in a few years if you all are playing second fiddle to another paper in town!

    And, at the end of the day, these "awards" mean absolutely nothing and, indeed, tell false stories as to what's best in Colchester. Consumers are not dumb, and will base their purchase decisions based on the quality of product/service they receive ... not because of a silly, biased award they might receive.

    Check out the Chamber website, http://www.trurochamber.com/members , PropertyGuys.com is listed under the heading REAL ESTATE -COMMERCIAL/INDUSTRIAL/RESIDENTIAL seems kind of ironic doesn't it ??

    After checking out the listed properties from the individual agencies in Truro, it's obvious why they didn't want PropertyGuys.com in the competition. She has more properties listed than any" agency" in town. Funny how the business with the most homes listed is excluded from the "sticky" Real Estate category.

    Tim Tucker and the Chamber have really fumbled this one... removing them because they are not an "agency"? That' is the most ridiculous thing I've ever heard. That holds about as much water as Bill Clinton's famous quote - "I did not have sexual relations with that woman." Get real Chamber and admit your mistake... don't lose any more credibility on this one.

    Dear Mr. Tucker, I want to personally send you a note to express my disappointment with your decision to “exclude” Dana Hernden from your annual Best of Colchester competition. As an active supporter of the Chamber of Commerce for the past 13 years, and having donated hundreds, if not thousands of hours in community service from our 100 plus franchise locations coast to coast, I find it difficult to continue to support my endorsement to our franchise owners of their local chamber of commerce. I can honestly state that I have never experienced anything like this in the past and I’m having a difficult time understanding why your decision makes any sense.     I find it interesting that Dana would want to be in the category of Real Estate Agent since their whole advertising campaign is based on the fact they are NOT. They do nothing but put down real estate agencies in their ads. Could it be that Dana has never read or seen her own advertising? This whole thing seems very silly and only makes her look foolish.

      I have to agree with Daphnee here. All Property Guys have ever done is put down and slander those "Joe Smoe Real Estate Agencies". They make it such a point to not be an agent, now they want to be voted the best among them? Have your cake and eat it too? Sounds like she's a bit sour to me. Chamber made the right call in my opinion.

      @ Daphnee - guess you didn't bother to actually read the article where is says, "Hernden agrees she is not a real estate agency but feels her business could've remained in the competition by simply adding "real estate/services" in the group heading." Guessing you are in the Real Estate Agency business based on your comments. And to be fair, I've seen a fair amount of Real Estate Board ads taking aim at business's like Property Guys.

    When the nominations started coming in for Ms. Hernden's Property Guys business, the Chamber of Commerce should have recognized that the business landscape has changed (and will continue to change) and create an appropriate section under the Real Estate category or "Other Services/New services" that fits this and other new businesses. But they made the decision at that time not to include her business which, given that the president is a Real Estate Agent, is quite suspect (or just an unfortunate coincidence). I imagine, given that voting just recently started, that there was enough time to add that category or another appropriate category. The Chamber should know that good business people aren't afraid of competition. It drives them to be better, and this bodes well for all customers as the bar of customer service gets raised. And given that there are 450 members under the chamber according to Mr Tucker, if all the business's can't be included in the "Best of..." in some way, shape or form, specifically if nominated, what really is the point of this type of competition? I'm sure Ms Hernden isn't the first business to feel excluded, and if they continue to limit the nominees, won't be the last.

    This is not what a Chamber of Commerce is supposed to be... You should be there supporting EVERY Business that are members. PropertyGuys.com is there to stay, so get used to it!! Ask her clients, ask the people who saved thousands in commission, they will recommend PropertyGuys.com over and over again, so get used to it Mr Tucker!!!

    With all due respect to the many, many honourable and forthright business people who belong to the Truro Chamber of Commerce for whatever reasons, the local organization is a laugh. As with many other groups in this tight little community, it is controlled and operated by a small cadre of individuals who determine who does what, and who will win "competitions" such as this one. Many people won't agree with me, however, I speak with some authority and knowledge on the matter: I managed three much larger Chambers of Commerce over many years living in another province, and I've learned to recognize when a horse is a horse, and not a mule. As for Ms. Hernden, I'm on her side.

    This certainly seems fishy. The retraction at the last minute seems like a shady way of handling it.. they should have kept it in by default and then amended the category next year. That's simply good business and the right thing to do. And Mr. Tucker's statement of "And given that the voting had started before the issue came to his attention, Tucker said it was too late to change the heading for this year." It certainly wasn't to late to remove propertyguys.com. To Mrs. Hernden : I think we all know who the clear winner is her.. You! :D

    PropertyGuys.com is a Real Estate company that is established to organize and facilitate the sale of a home between two parties - the home owner and the buyer. Which is exactly what an 'agency' is. We sold our home through PropertyGuys.com and Daina was fantastic. I have dealt with Realtors in the past and the service Daina Hernden provided was incomparable. I am frustrated that she is not getting the credit she deserves in the real estate 'category' of this competition. I can't help but think Realtors (and Royal LePage) are scared that the great publicity PropertyGuys.com would get from WINNING this award would influence an even greater share of their market to switch over to private sale. But furthermore, whether these traditional Real Estate "Agencies" are scared or not, the Chamber should be an un-biased system there to support ALL businesses.

    Good for you Mrs. Hernden. It's about time someone spook the truth in regards how politics plays these games at all levels. Step up Mr. Tucker and allow Dana the same opportunity ALL chamber members deserve. What are you scared about? Who's going complain ... your real estate friends?

    Great thing about this Daina, it shows the public that the other real estate agencies are scared to compete with you and rightfully so. I would also ask for a refund from the chamber as they are pushing the agencies & not your business.
