HALIFAX - Derek Thomas MacPhee had unflattering words Tuesday for the man he's accused of trying to kill.
"Tell Regan, `Thanks, big ... rat, tough gun,"' MacPhee yelled toward the gallery as sheriff's officers led him out of Halifax provincial court.
MacPhee, 28, of Harrietsfield was charged with shooting Regan Taylor Henneberry, 25, in a convenience store parking lot in Sambro on Monday night.
Henneberry is believed to have been released from hospital on Tuesday after being treated for four bullet wounds in his leg. He was originally listed in serious condition Monday night.
Capital Health spokesman Peter Graham said he could not provide any information about Henneberry's condition.
At MacPhee's arraignment, his lawyer, Cameron MacKeen, asked Judge Barbara Beach to put further matters over until Wednesday.
A bail hearing will not be part of the next court appearance.
MacPhee is charged with attempted murder and aggravated assault in the shooting of Henneberry and also with nine weapons-related crimes, including possessing a firearm when prohibited from doing so.
"Both the victim and the alleged shooter are known to each other and are known to police," said Const. Brian Palmeter of Halifax Regional Police.
Last May 27, MacPhee became the first person in Nova Scotia to be forced to wear an electronic ankle bracelet for a car-theft conviction. The bracelet was to allow police to better monitor MacPhee, a repeat offender, for a year.
That was one provision of an 18-month conditional sentence, including nine months of house arrest, he was given after pleading guilty to stealing a car and possessing stolen customized door handles.
